tree limbs

my tree hangs over my neighbors house, it appears to be rotting at the trunk, but all of the leaves are green. my neighbor wants me to remove the portion of the tree hanging over his house, as he ''fears for his safety.'' Can he force me to remove the tree, or bill me or sue me if he removes the tree and/or associated limbs?

Also, what is the statute of limitations on this issue as I have had a tree person look at the tree, and he informed me that he had looked at the tree two years ago when the former owners lived here and he gave them the same information about the tree rotting... Could I go back on the former owners on this issue?

Since you know the tree is rotting you should remove the whole tree and the limbs. Should they fall you would be responsible for damage. He also has the right to remove the limbs over his property.
