Legal Question in Real Estate Law in Florida

Tree down on neighbors property

My elderly parents own an undeveloped lot in Florida. The person in the house nextdoor called them claiming a tree on my parents lot looks as if it were going to fall onto her property.

1)If the tree falls and lands on the nieghbors property are

my parents responsible for any resulting damages to the

neighbors property?

2) Are my parents responsible for the tree removal from the

neighbors property?

Thank you & regards

Re: Tree down on neighbors property

Since they have put your parents on notice of this hazardous condition I would check this out since they may be held responsible.

Re: Tree down on neighbors property

The bad news is that your parents are responsible if their tree falls on their neighbor's property.

The good news is that this is probably covered under the liability portion in their Homeowner's insurance policy.
