unethical Attorneys fees???

We filed a complaint against our Title/settlement company for mishandling our settlement.Their Title Ins License was revoked by the state of FL in Jan 08 for fruad, ect.. we just learned that the same title company has been funding the legal fees on behalf of the seller, who has sued us for half the property back. It is ethical for a lawyer, who has told the FL Bar he does not represent the Title company in any way shape or form, yet the title company has been paying the legal fees for over 2 years and counting. The Title co. had a fiduciary relationship with us, the buyers, how can they fund the lawsuit against us?The city's zoning states we can not split the property. Out Title insurer denied us representation against their agent, the above mentioned Title company.

It is ethical for a lawyer to receive funds from a source he does not represent so long as he has no conflict of interest with the source he is receiving the funds from. It sounds like he has no conflict with the title company, so it doesn't sound like he's doing anything unethical.

You may have an action against the title company for your attorneys' fees, though you should check with a property attorney to be sure.
