Legal Question in Real Estate Law in Florida
Unethical Standard Practices
We were preapproved for a loan to puchase a home. We picked out the home. Our agent put our offer in to the listing agent who told us that we need to close the deal through their broker per the owner's request. We had already been preapproved and didn't feel we needed to go through their broker. In speaking with the owners' they never said a buyer had to close with them. Due to the brokers strict guidelines, we could not get a loan through their broker and was told we can't get the house. The owners accepted our original offer but had questions about the closing, we turned in a 2nd offer which they never sent to the owners. Now the listing agent says they have another offer and we will be 2nd if they don't come through. Do we have any legal recourse? Please advise. Thank you

If you believe that the real estate brokerage firm did not act properly you can file a complaint with either of two sources or both. The first is the Board of Realtors in the county/city in which you are located. The second would be the Florida Real Estate Commission (FREC) which oversees all licensed salepersons and brokers throughout Florida.
