Legal Question in Real Estate Law in Florida
The Water & Sewer company in Miami-Dade, FL shut off my water 3 weeks ago due to non-payment. But I had paid the water bill and when I took a close look at the Notice I noticed that it was for another address not my home. So I called the Water company and they admitted that they had mistakenly shut off the wrong home and would send someone out to turn the water back on but that was almost three weeks ago and I still have no water. Can I sue the Water & Sewer company for their recklessness and my inconvience?

If you have no water go down to their office, and don't leave until you get a supervisor to get the water turned on today. If it's still not on by tomorrow, go back to their office and don't leave until you get the name of the supervisor's boss. If you still have a problem after going into the office, go to your local legal aid clinic, and ask them to have an attorney place a call to the county. I agree that they are negligent, and I also agree that you should be able to sue them. Unfortunately, the legislature and courts disagree, and government officials are protected by governmental immunity for their indifference to your inconvenience due to their incompetence.
