Legal Question in Real Estate Law in Florida
waterbill on a foreclosed property
Hello,
I am one of two people on a title of a property in Palm Coast, Florida. The other person passed away last august, the property went into foreclosure. Even though the water was turned off, the water company is still charging me ~$50 every month since my name is on the title. I do not live there and have nothing to do with it at this point. I am afraid to stop paying since they are threatening to report me to collection. I was under the impression that judgements are given on property and not the person on a title. Can it ruin my credit history in any way if the property is being take away by the bank?? What can I do at this point for them to leave me alone??
Thank you for all your help

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. If you do not agree, then stop right here, and do not read any further.
If you are the owner of the property, you are responsible for all debts until you either sell the property or it is foreclosed upon and judgment is obtained. If there is any equity in the property, you should try to sell it rather than let the bank foreclose as it will substantially hurt your credit. I do not know why the water company would charge you $50 each month if there is not water useage. I pay less than that and use water at my home. Judgments are on the person whose name is on the property.
You need to consult a Florida attorney before this matter escalates any further. They will not "leave you alone" as long as you own the property.

until the judgment of foreclosure is signed you are the owner and responsible.
