Legal Question in Real Estate Law in Florida
Ex Wife On The Mortgage
My fiance's ex wife deeded the house over to him. He wants to sell, but found out that she's still on the mortgage. She probably won't sign the papers, so we will need to litigate. She is very vendictive.

Re: Ex Wife On The Mortgage
When the house sells, he can pay off the existing mortgage. The ex can't stop it, and she doesn't have to sign anything. Then she's out, and he won't have to worry about her any more.

Of course she is on the mortgage. The mortgage company would not have loaned the money otherwise. But, so what? He owns the property and can sell it. She doesn't have to sign anything. You are all upset about NOTHING.
