Legal Question in Real Estate Law in Florida

Will I be thrown out on the streets in 24 hours?

I have 5 children My landlord knew my husband was stealing my rent money so she agreed to give me a chance to catch up. now she has proceeded with court eviction. My parents tried to contact her to make arrangements for paymen she refused to return calls. I don't have the money to put in the registery of the court will I automatically be denied and thrown out in 24 hours. Or will the court giveme chance to start payment? She threatened to throw me out if i had company but not other tenants, said my husband couldn't make extra money working on cars but lets other tenants have broke down cars on their yards. she did not inform me that the man across the seet was a convicted sexual preditor agianst children he is her tenant. The amount of money owed on her papers never match. so how do i know what i really owe. she let the water bill go 2 months nonpayment got shut off my parents paid it with credit card. she says i haven't paid jan 02- june02 but i have caceled check and when my lease expired in feb i made sure she got paid so i didn't get thrown out. she never provides reciepts says she will but doesn't. please tell me what to do legaly so my children aren't homeless.

You may have a defense that may provide you with a set-off or credit for payments received by the landlord or landlord's representative, but ultimately you will need to get your house in order and pay all the rent on a timely basis. Otherwise, you will be sued and eventually evicted. It appears you may need legal assistance for matters unrelated to a landlord-tenant dispute. In light of your financial condition, contact Legal Services of Greater Miami or the Put Something Back Program to learn whether you qualify for free legal assistance. It does not seem likely that you will be able to afford to hire an attorney on your own, especially if your husband continues to take your money. Good luck.
