Legal Question in Sexual Harassment in Florida
My rights after EEOC
My employer fired me after I reported sexual harassment, fought my unemployment benefits and assassinated my character to justify their actions. The EEOC investigated for almost a year and then dismissed the case giving me 90 days to bring suit. The investigators letter sounded as if the employer was totally believed over me. I then asked FCHR to give their decision a substantial weight review. I am still waiting to hear from FCHR. Is the deadline extended to bring suit against my employer if FCHR is reviewing EEOC decision? My 90 days will be up August 11.

Re: My rights after EEOC
I wonder if you have set down the facts of your question correctly and I say that because it is usually the EEOC which conducts a substantial weight review of a FCHR finding. In any event, a 90 day right to sue letter issued by the EEOC gives you 90 days and no more to file suit. You need to talk this matter over with an employment attorney as soon as possible. Please send me an e-mail if you have any other specific questions.
