Legal Question in Sexual Harassment in Florida
sexually harassed and my supervisor wouldnt do anything..
One of my co-workers has been harassing me for about three weeks now, I've asked him to stop and he wont, so i went to my supervisor this Monday and she told me that i could file a formal complaint but it would not go anywhere because i don't have a witness so i might as well not. I figured since my sup wouldn't do much i would take care of things. This man's wife also works with us, so i sat down with her and asked her if she could talk to him and ask him to back off. She was very nice about it and told me that she would ask him to stop. The next thing that i know her sup is pulling me into the office asking me what has happened and tells me she is filing a complaint against this man. Last night at work i was informed that the man's wife is filing a complaint stating that i harassed her, and that i am going to get some form of a reprimand today. I was not threatening to her or anything like that. Are they allowed to do this to me?

With regard to the harassment you may have experienced; in general, an employee must follow an employer's procedures for reporting harassment (regardless of a supervisor's statement that nothing will happen) in order to preserve any claim you may have against an employer. As for a complaint against you, an employer would be obligated to look into the complaint and, could choose to reprimand you based solely on the complaint; even if the complaint was not accurate. Each case, however, is fact specific and you would need to contact an attorney in order to get more detailed information regarding your rights.
