I have a Living Trust in the state of Florida. After I die are the distributions from my trust to my beneficiaries (my children) taxible to them?

Typical lawyer answer: It depends on what is being distributed and what the trust says. If the distributions are made as if they were bequests under a will, then probably not (there could be issues on distribution of post death income generated by the trust). However, if some type of tax deferred income is being passed through the trust ( IRA, 401K, etc...) then that portion can be taxable as income to the beneficiaries. Again it may depend on the trust language.
