Tax Representation, Lawsuit
I hired a firm to represent me to the IRS and submit a OIC back in 2004 (paid $4500 in ful in 2005) - here we are in 2007 and my case is still open. I have gone around an around with them... Recently there has been a class action law suit (that I was not made aware of) and by law have been included in the lawsuit. Now the company representing me obviously thinking I am invovled do longer represents me, the firm handling the case says I never submitted my form to be included -- in the mean time the local IRS agent is demanding payment... I can either opt-out (hopefully the appeal would go through) and have this firm represent me again (for who know how long) or take a chance with the lawsuit which has already been awarded for 6mil - but I do know know what I would be entitled too. I do not know where to go, no one from either side is allowed to give me advice... Thank you for any support you can offer.

Wow. you do have a problem. Is the class action in Federal or state court? Has the class been certified? It sounds like the firm may be going under. Do you know? If so, they may not be able to help you anymore. Have you asked them?
The IRS isn't going to wait, so you need to decide to either proceed with the prior firm or get new representation regardless of whether you decide to participate in the class action. I am in Florida and part of my practice is tax disputes and controversies. I may be able to asist with your tax problem if you decide not to proceed with your current representation.

I have many clients who were involved in the J.K. Harris nightmare. They were all sent the same letter telling them that they could no longer represent them because they were part of the class action suit. The ironic part is that they were never really represented in the first place. Your case should have been resolved long ago. I am an attorney in Florida who specializes in resolving IRS problems.
