Legal Question in Traffic Law in Florida
Adjudication Withheld Option on a Speeding Ticket
I am looking for more information on this option. I understand it is only available in certain counties - one of which is St. John's County, where my husband received a ticket, prompting this inquiry. My biggest concern is the line that says ''Please note, by selecting this option, the court may impose a fee up to $500.'' We're only talking about a $43.00 ticket here, but my husband has a commercial license and does not want points to go on it. This option is no points, and no school, and we understand (from the police officer) that it is usually approved, provided the person's driving record is good (which my husband's is). So he wants to choose this option.
I am in a hurry for an answer....the 30 days to respond is almost up. Thank you.

Re: Adjudication Withheld Option on a Speeding Ticket
Sorry response is so late. I hope it helps. The $500 warning is informing you of the maximum penalty. This is hardly ever administered unless the person challenging the ticket has a bad driving record. If your husband has a CDL you should always consider hiring an attorney for tickets to ensure no points are put on his license. Most often a good driver can get no points and no school on a first ticket without too much problems from a hearing officer or a judge. Of course it depends on the nature of the ticket, the disposition of the hearing officer or judge, and the attitude of the law enforcement officer.
