Legal Question in Traffic Law in Florida
Conducting a lawful stop?
I have a friend that was pulled over because the officers said that they smelled a funky odor coming from the vehicle. My friend was arrested because illegal items were found in the vehicle. Later the officers changed there stories and said that they stopped her because of a tail light that was out, but the tail light wasn't out. Is there anything that can be done in this situation?

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. If you do not agree, then stop right here, and do not read any further.
It will be up to your friend's attorney to challenge the stop and whether or not it was lawful. They can illicit testimony of the officers and any witnesses including the driver. If there are any inconsistencies, the court may not believe the officers. This is where a good lawyer excels and distinguishes himself or herself from a novice.
