Legal Question in Traffic Law in Florida
I went to court to tell my side of the story involving a traffic citation and took along a witness. After sitting for two and a half hours it was my turn. As I approached the podium the judge said sorry, we have to reschedule you. We don't have the results of the criminal citation yet that was issued along with the traffic ticket. The criminal citation was dismissed on Friday and my court date for the traffic citation was Monday so I can see how it wouldn't have been in their system yet, but no one told me that anything had been cancelled. The police officer was there (he gets paid), the judge was there (he gets paid) and I was there, along with my witness. Neither of us gets paid of course. Now I'm wondering if I can ask that the citation be dismissed since I was there, no one notified me that it was going to be cancelled, and my witness has a hard time making it in. It surely wasn't my fault that the state couldn't proceed. Why did they schedule it if they couldn't do it? Not my mistake. What say you? Thanks!

It may be possible to get it dismissed if it has been more than 180 days since the ticket was issued based on speedy trial grounds. It would be a good idea to get an attorney to see if that is a possibility or if there may be other motions.
