Legal Question in Traffic Law in Florida
I decided to go to court to fight my speeding ticket. I showed up but the police officer did not. The judge said that the officer never responded to the subpoena so I can either pay the fine and court costs or come back another day. I have two questions. What kind of responsibility does a law enforcement officer have to responding to a subpoena? In addition, why didn't I have the option of having the citation dismissed since the officer did not show up to court? Thank you.

Some judges will give the officer a second chance if they had a good enough reason, other judges will dismiss. Every jurisdiction in FL handles these slightly different so if you're going to fight it, I suggest you contact an attorney in your area.
