The issue is not whether you are determined disabled. The issue is whether the medication you are taking AND/OR your condition prevent you from operating a vehicle safely. Haven't you seen the Blue or Red "Handicapped Hangers" or the tags for disabled individuals?

If you are regularly taking a narcotic medication or one that interferes with your ability to operate a vehicle then, yes you can be charged with operating a motor vehicle under the influence. If your disability prevents you from safe operation then you will likely be charged with something else.

Talk to your doctor and find out what restrictions you actually have. You may have to specially equip your vehicle, or you may have to sell your car.
