Legal Question in Traffic Law in Florida

Driving on suspended licence

This is my third time for this. the first time I pled guilty. The second time I pled not guilty and got charged driving on a suspended licence. I pled not guilty this time. Do you think the judge will take my licence away for five years if I am convicted?

Re: Driving on suspended licence

The Judge does not have the ability to take your driver's license away on that charge. If you resolve your current charge as a DWLSR, you may get "habitualized" by DHSMV and that would be a 5-year administrative DL suspension.

You should get an experienced attorney who can help you get your license back and try to persuade the State to amend your current DWLSR charge to a No Valid DL charge which would prevent you from being Habitualized.

Good luck.
