hit and run

i was in a hit and run car accident with minor damage. what kind of charges am i facing?

Hey:

The potential charge against you depends on whether a person was hurt. If it was just property damage, the charge is only a misdemeanor, if someone was hurt, a felony. Either way, you first plead not guilty and ask the judge to pass the case to a later date. A lawyer would conduct discovery (get docs./reports from the State--see if there were witnesses, etc.) and at the same time negotiate a good plea with the State in case you don't want to go to trial.

Usually, if a defendant does not have a prior crim. record, the State only wants probation to make restitution to the victim. If it was serious personal injury (a felony) it is a lot more serious. Leaving the Scene of an Accident with property damage is a 2nd degree misdemeanor with a possibility of up to 60 days in jail. I represent individuals charged with this offense in Duval County.
