Legal Question in Traffic Law in Florida
My husband drives a car with separate shoulder harness and lapbelt, the shoulder harness jammed so he was just wearing the lapbelt. He was pulled over and issued a traffic ticket for not wearing a seatbelt even though he was wearing his lapbelt. I have researched the law (State Statute 316.614(4)(B), and it says only you must wear a seatbelt at all times while operating a motor vehicle, it does not specify whethre or not you have to wear both shoulder harness and lapbelt in vehicles with separate belts. Do we have grounds to succesfully fight this ticket in court ?

I'd say it's worth fighting. Of course, it depends on who is representing you and who the judge or magistrate is.
