Legal Question in Traffic Law in Florida

on jan 27,09 my brother resided hillsborough county; he was on his way home from buying food when he changed lanes and ended up being struck from behind. He got out of his jeep and went to check the people in the other car. There were 3 females in car and he asked the driver if she was ok. The female on the passenger side was telling the driver that she had to go to the hospital.A female police officer showed up and said that she had seen my brother do an illegal lane change. My brother had insurance. The police officer gave my brother a ticket and the other drivers car had to be taken away by a tow truck due to severe damage. He called his insurance and the adjuster came out took his information and he took them a copy of the accident report. He did not hear anything more until he was served a summons stating being sued by other drivers insurance company for damages which exceeds $15,000 exclusive of interests and costs plus $5,032.13 for necessary medical expenses suffered by female driver. Summons state that the insurance company was forced to pay the sum of $20,000 in uninsured motorist benefits for the personal injury suffered by other driver. He has 20 days to respond. We called the insurance he had at the time and they claim to have payed about $8,000 for damages to the other driver for damages to her car but since my brother only had minimum coverage for insurance they will not pay anymore and they claim they sent him a letter in june of last year explaining that and that he is basically on his own. We are unsure how to proceed, we have called a couple lawyers ofc but they have told us to give the info to the insurance company and they have to take care of the situation, unfortunately insurance company claims they are not liable for anymore. What kind of lawyer will we need and about how much will it cost for a case like this. Any advise would be extremely appreciated. Thanks in advance

You need to get a civil lawyer that handles civil defense and who will do this on an hourly basis. Normally your insurance would cover it, but since it appears that your insurance lapsed, you are on your own to find a lawyer. This is NOT one done a contingent basis, and must be done hourly. Good luck.
