Legal Question in Traffic Law in Florida

Can I plead guilty to driving with a restriction on my license (interlock device) in a rental car involving an accident (careless driving/my fault) and not get the 60 days in jail? What about a fine or minimal probation? Case is in Florida.

Your question is a little confusing, but let me try to understand. It sounds like you got charged with driving in violation of your restricted license. If so, then you face up to 60 days jail. You may have a defense to that since you were in a rental car, but I would need more details. If so, then you may owe the court nothing, including no jail. On the other hand, if the charge is just careless driving, regardless of fault, then you ONLY face a fine and possibly driving school. Either way it would be a good idea to get an attorney. I practice in Pinellas county if you wish to give me a call, I can help with either issue you have.
