Legal Question in Traffic Law in Florida

private parking lot accident, uninsured motorist

I was leaving my apartment complex, and when I backed out of my parking spot there was a vehicle that was not parked in a designated parking spot but stopped for the moment. I backed into his car causing a dent about 1 ft. in diameter. to his back left side(probably about $500 damage). I was unaware untill the next day when I called my insurance company that my insurance had lapsed. My car is registered in mine and my boyfriends name and he(bf) is worried that this will all end up on his record, because the other persons insurance company is sending us papers in his name. What legally can the other car driver do against us. And does my boyfriend have anything to worry about. Cops were called to the scene but no tickets were issued beause it being on private property. HELP IM FREAKING OUT HERE. PLEASE!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

If you do not agree, then stop right here, and do not read any further.

I am sorry to inform you but your boyfriend has some very valid concerns. All owners of the vehicle are responsible if an accident occurs. The other party can sue either or both of you to collect monies for damages caused by the accident.

I strongly suggest that you speak with the other party and make arrangements to pay for the damage caused. This will save you more money later including court costs and possible attorney's fees.

Further, under Florida law, if you cause damage to another party in an accident to another person and they obtain a judgment against you, they can file with the Department of Motor Vehicles to have your drivers license suspended. It will then not be reinstated until and unless you have paid the other party.
