Proof of Insurance
Proof of insurance provided to officer, but he'd already written the ticket...
Insurance company sent it in per sop -- personally delivered a copy as well... all prior to court date. For some reason the ticket was not dismissed and now there are all sorts of problems. A call has been made about this, to no satisfaction.
Is this legal? How can charges of lack of insurance be made when proof was submitted not only to the ticketing officer at the time of the ticket, but also submitted by insurance company and in person.

Sometimes papers that are not marked with the Cause number get lost in a pile marked "File this Someday When You Get Around to Finding the Right File"
Never just hand someone something like that. The legal system deals with tens of thousands of pieces of paper and you should never simply give a piece of paper without a cover letter and/or motion to explain what it is and in whose file it should be placed.
At this point, you're going to have to do one of three things (assuming you've got an Indiana case): (1) Hire an Indiana lawyer in the location where the court is; or (2) Go to that court yourself and explain it to the court with a copy of your insurance papers; make an extra copy for the prosecutor's office; or (3) contact the prosecutor's office handling your case and fax the information to them (with your name and cause number) and an explanation and ask for a dismissal of the case.

Your question does not state why this is a Fla. legal issue. Did you receive a ticket in this State? Was there a traffic accid.? Since I do not have an answer to that and some other q.s I have, I can only give a general answer. Have you already been to court for a trial? If no, Simply go in and show the court you had insurance at the time. I believe if your evidence is genuine, the court will dismiss the infraction. Good luck. Tom Rosenblum
