Legal Question in Traffic Law in Florida
Pulled over but wasn't doing anything wrong.
My husband was pulled over two days ago, but did not do anything wrong. The police officer drove next to him and looked into his car and then slowed down to follow him then proceeded to pull him over. He had an expired driver's license but current registration/tags. Is this legal? The police gave him a summons and a court date. I want to know what my husband's rights are and if that is actually legal to do, considering he wasn't disobeying any traffic laws.

Re: Pulled over but wasn't doing anything wrong.
It depends on what the officer put in his report as to the reason for making the stop.
Based on what you wrote, it sounds like his constitutional rights may have been violated.
I was a prosecutor and now defense attorney here in Broward County, give me a ring and we can chat about his options further.
take care,
