Legal Question in Traffic Law in Florida
I received a ticket in port St lucie florida for speeding. The police car was stopped at a traffic light and I wascoming around the corner within 400 feet of the light when first visible to him FROM THE REAR. ( I am aware that some cruisers have rear radar.) The gentlemen asked if I had been drinking . i had not and it was not an issue, he asked ONLY for my license and said he did not need m y insurance or registration. About two minutes later he returned, without ever explaining how he discovered I was speeding he tossed a ticket inmy car for 74 mph in a 45 and told me he had a pursuit that he had to go immediately. He went to his cruiser and had to wait 45 seconds or a minute for the car being pusued and 5 cruisers to pass by before he could pull out and join the chase ( being the 6th or 7th car in line) I then discovered he HAD NOT SIGNED THE TICKET NOR HAD HE ASKED ME TO. The ticket says I am not required to sign. There is a little box checked with a computer generated "x" that says he gave me the citation but next to it there is a place for him to sign and it is not signed. Can I go to court and dispute this ?

Yes you could dispute, but it is possible the officer could "fix" his mistake by the time court comes around. There is no REQUIREMENT that you sign a ticket, despite it being preferable. You should hire an attorney to fight this for you as there might be an identity issue, and if you aren't there they might not be able to identify you and they could cross examine the officer on this issue. Best advice is to talk to an attorney in your area.
