Legal Question in Traffic Law in Florida
I received a traffic ticket for speeding and doing 74 mph, and the ticket says it was a 55mph area. The statute written on the ticket is 316.187(2)(c), when states "The Department of Transportation is authorized to set such maximum and minimum speed limits for travel over other roadways under its authority as it deems safe and advisable, not to exceed as a maximum limit 60 miles per hour." If this means I was actually over 14 instead of 19, this drops my ticket fine $50. Am I correct, and if I am, how to I go about getting it corrected?
1 Answer from Attorneys
55 mph is under 60 mph so the statute cited is correct, and you could be held liable for 19 mph over the limit. In other words, there is nothing to correct. You should hire an attorney to see if there are any other defenses.
