Legal Question in Traffic Law in Florida
I was recently served a subpoena as a witness to a car accident to appear at a hearing. I gave a witness statement at the time of the accident and was not informed that I would be needed at a hearing. I don't feel comfortable going and was wondering if there was a way to not appear.

I can not advise you not to appear, but in 16 years I have never seen anything happen to a witness who didn't appear in TRAFFIC court since the court has the contempt power to impose on witnesses who don't appear. There are just too many cases for them to worry about a witness. Let me reiterate however, that I am not advising you not to appear and a court has the power to hold you in contempt for failing to appear, but I have not seen it happen in TRAFFIC INFRACTION cases. (If this is criminal traffic, then you must talk to the prosecutor, or the person who issued the subpoena).
