Legal Question in Traffic Law in Florida

traffic ticket

My step son got pulled over saturday night because his lights were out. After getting fresh with the cop, the cop ended up searching the car and finding a tin with resdue of pot. The other kid in the car came forward and admitted it was his, but it is stil my step sons car. They are due in court next month. My question is do we need an attorney or should this be a warning to my step son?

While your step son certainly has the right to represent himself on the possession of marijuana charge, I would compare it to having him try to drill his own teeth if he had a cavity. It is allowed, but not advisable.

Possession of marijuana is a first degree misdemeanor punishable by up to 1 year in the county jail and/or 1 year probation. Furthermore, if he is convicted of that charge, he will receive a 2 year driver's license revocation. If you son has little or no criminal record, he may be eligible to apply for a pretrial intervention (PTI) program, which would help him avoid a conviction. Aside from the possibility of losing his license, a drug conviction can haunt you forever when you apply for college, jobs, loans, etc.

Your son should retain an attorney. The attorney will enable your son to minimize the penalty and expense to your son. Depending on your son's history, he may be eligible for a pre-trial intervention program which can lead to formal charges never being filed by the State.
