Legal Question in Traffic Law in Florida

An uninsured driver backed out of a parking spot directly into my car causing damage (I was driving down the isle of the parking lot - she hit the read passenger side of my car.)

She told the cop she had insurance and gave a company name. When my insurance company called to verify her coverage (based only on the company name and her information from the police report) they said she hasn't had a policy with them in 2 years.

I plan to take her to small claims court to get my car fixed and pay the legal fees, but my question is this:

Did she also commit a punishable offense by lying to the cop about having insurance?

Yes, she can be charged for filing a false police report or giving false information at an accident. You should contact the police if you want to press charges.

You can contact the police who may charge her with no insurance and/or false information.

Hopefully you have uninsured motorists coverage as then your own insurer will pay for repairs.
