Legal Question in Traffic Law in Florida
My wife went through a red light and we later got a letter saying our car had been photographed going through the light and would we please pay the $158 fine. Problem is that the car is in my name, so the letter actually was addressed to me, and apparently I am the one being held accountable for the ticket.
As a practical matter, it doesn't matter to us whether I pay the fine or she does, since the money all comes from the same account. My question is this. Is there any reason I should go through the effort and expense of submitting a notarized statement that my wife was the driver of the car and not me? The letter claims that "no points will be assessed" for the violation "nor will it affect vehicle insurance rates", but can I really believe that?

Since you're both essentially paying it, it makes little sense to file the affidavit. That said, there are certain defenses that an attorney can raise. However, the cost for the attorney will be more than the $158 so is it worth it to you?
