Legal Question in Traffic Law in Florida
I witnessed a car accident in Melboure, FL on May 3rd 2013.
I received a phone call last week from an investigator working for Allstate insurance. He recorded my statement on the accident. I just received another phone call, from an attorney representing one of the 2 drivers involved in the car crash. He wanted to ask me a few questions. I would like to know if I have to answer his questions on the phone. What will happen to me if the case goes to court? Because the accident happened about a month ago, I am not sure I remember everything correctly, it went so fast. So basically, my questions are:
- Do I have to talk to that attorney on the phone?
- Do I have to talk during the court ?
- What if I can't remember everything correctly?

No, you don't have to talk to an attorney on the phone. You can even hire your own attorney. You do however have to talk to in court if you are subpoenaed. Often times, the attorney may want to ask questions so that you don't have to be subpoenaed. If you can't remember, then you can't remember, and you can tell the court that.
