Legal Question in Wills and Trusts in Florida
I own 1/12 of a home that is part of an estate. The estate is settled except for the house. The administrator of the estate who is also a owner of the house was paid well. Now the adminstrator of the estates lawyer has sent a document to list the home with a realtor or auction it off. My problem is the consent form has a clause giving the administrator additonal fees for expenses incurred with respect to the house since last year. Is this fair or should I ammend this contract?

My first question to you is was the home the decedent's "homestead" at their time of death? If yes, the administrator may be overstepping their bounds. If not, as a co-owner nothing requires you to sign any listing agreement or auction agreement. You should negotiate for the best deal if they want your cooperation. I highly recommend you retain a lawyer to advise you of all your options.
