Legal Question in Wills and Trusts in Florida

1/4 share in condo

When my father died he and my brother and 2 friends had shared ownership in a condo , but only the 2 friends were on the deed/title, (a separte contract was writen to include the)would my fathers share automatically pass to my step-mother , he had a will made in 1990 and the condo was purchased in 1984 but he died in 1995 if that matters, and does she still have to file his will even if it passes, thank you for your time and help...

Unles property is titled joint tenants by

the entirety, they do not pass to the

surviving spouse. Such assets are controlled

by the Will. It sounds as though there

is a contract right which does not include

your step mother, would appear to be

distributable by Will, and the will should

be probated
