Can I sue my attnoney for not filing my mothers will with the court or any needed documents that would have made me administrator and been able to save her house from forclosure? I paid a retainer he literally has done nothing except give me lip service telling me that everything was in the work. I have it under control, I recieved notice that the house will be auctioned off next month. this is the house I am currently residing at and per the instructions of the will was left to me.

You might have a malpractice action against the attorney if it should come to that. In the meantime, why not obtain a different attorney who can immediately file the necessary pleadings and avoid the foreclosure action? If your attorney is not working fast enough to satisfy your needs (and those of your mother's lender) then you have every right to change attorneys and demand any monies you paid to the attorney to be given back.
