Legal Question in Wills and Trusts in Florida

Beneficiary on Banking Accounts

My mother passed away and named myself and my nephew as beneficiaries on all here accounts (checking, savings, and money market CD). The bank said I don't have to share that money with my nephew. I find that hard to believe. Also, do I have to make all that money available to the estate for debt or just the money in the checking account? She does have other assets (house, car, property, etc) so her assets are greater than her debts. She did not have a will so we will be assigning an executor which will most likely be my older sister since she lives in the same state.

Re: Beneficiary on Banking Accounts

If you are both named on the accounts, the payments will be to both of you. It would not be part of the estate.
