Legal Question in Wills and Trusts in Florida
Beneficiary
As stated before, my mother died and named me and my nephew as her beneficiaries on all her banking accounts. I forgot to mention this is in Florida. Is that money ours free and clear and do we need to put it in an estate account to pay bills until assets are sold? Also, my nephew is 13 and she was his legal guardian. We are in the process of trying to figure out what is going to happen to him. I have a sister and brother (his dad) in Florida and I am in PA. Anyhow, I don't want to just give him $20,000 + dollars and I don't want his dad getting his hands on it. Can I set up a trust fund for him with that money?

Re: Beneficiary
You will need to probate your mother's estate and should consult with an attorney in the county where your mother resided, or any county where she had property.
Who is the child with now? A temporary guardianship may be needed until the court can determine how to proceed.
If you call my office I can assist you, or help you find an attorney where your mother lived to help you out.
Re: Beneficiary
A guardian of his property needs to be appointed.
