Legal Question in Wills and Trusts in Florida

My brother is dying in fl hosp. If i sign a health care proxy or power of attorney am I responsible for hospital bills. He has no insurance and has been homeless for 2 yrs. The hospital is pushing for me to sign. If I refuse to sign will I still be able to obtain body and bury in family plot in Ma.

You are right to be concerned. Normally your brother would sign to give you the authority. If the hospital wants you to sign something you could, but be very careful on what it says.

If it says anything about making you responsible, don't sign. Read everything thoroughly first. If you sign, make sure you add your representative capacity.

Obtaining the body is the responsibility of the Personal Representative, and if there is no one named, then the nearest realtive starting with spouse, children, parents then brothers and sisters.
