Legal Question in Wills and Trusts in Florida

My brother and I have been willed a home 50 / 50. He lives in the home. Taxes are due in Jan we need to sell the home. He can't buy me out. I need to evict him to sell the home. Is that possible?

If title is in both names and you want to sell, you may bring an Action in Partition against him.

You cannot evict him as he has a possessory right equivalent to yours. A partition action to sell the property is the only option.
