My parents adopted my now 12 year old son when he was 1 yr old. My mother passed away 5 years ago where my husband and I came to live and take care of my father and son. My father recently was hospitalized and has been there approx. 3 weeks and may be in there for another 4 weeks. Upon recieving devestating news, my father wrote a will and had it certified. If my father should take a turn for the worse, is his will to be followed through, am I automatically the legal guardian (again) to my son. If not, how do I obtain custody again of my son and follow the wishes of my father, his property & belongins?

You would have to petition the court to be appointed Guardian of the child. Your father's will would be persuasive evidence in helping get you appointed. Jim Rose
