Legal Question in Wills and Trusts in Florida

If two children are too young to receive a death benefit from an insurance policy and the deceased puts it in her brothers name with a Will indicating her intentions for the money and he absconds with the funds, are there any legal actions that can be taken?

Please help my sister's sons as she died of cancer when they were 8 & 9 as a single parent who was also a police officer.

you need to probate your sister's estate and then have him charged with stealing their funds - he will l. have to make restitution and 2. spend time in jail.
