Legal Question in Wills and Trusts in Florida

Can we contest father's will?

My father recently died and left a widow that he was married to for 3 years. My mother passed away 8 years ago; parents were married for 39 years. We are pretty sure that my father left everything to second wife. Siblings and I feel that she(and more specifically, her children when she passes on) should not be entitled to money and property my mother left my father. Can and should we contest his will? Also, how long after a death is a will to be read?

Re: Can we contest father's will?

You must have grounds to contest a will such as fraud, incompetency, undue influence. There is no specific time for probate. The will must be located and read. Call the wife and ask if he left a will. As his child you certainly have right to a reading.
