Legal Question in Wills and Trusts in Florida

Contesting a named beneficiary to an Annuity

I was named beneficiary to an annuity that my father held, he is now deceased. The Insurance company wrote me a check and sent me the funds. The other members of the family have mentioned contesting. Can they do this and if so what recourse do I have?

He also had an insurance policy with my mother named as beneficiary ( she has received these funds) The rest of my fathers' estate was in both his and my mothers' name-I am assuming this is hers and can not be contested?

Re: Contesting a named beneficiary to an Annuity

Normally no. Annuities pass outside of the estate and are contracts between the deceased and the insurance company

Re: Contesting a named beneficiary to an Annuity

The insurance company is obliged to pay the named beneficiary. The proceeds are not subject to creditors of the estate. The money is yours.
