Legal Question in Wills and Trusts in Florida

How to Get a Copy of Former Will (FL)

I want a copy of the former Will of my deceased Uncle. I am named in the last Will and it was revised 3 days prior to his death. I'm told by the attorney who created the revision/last Will that the reason a new Will was created was to be sure his son did not have claim to the estate. I want to see the copy to be sure that is the truth.

You will need an attorney and will have to petition the court where the probate is pending.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

You do not have any legal right to see the prior will which has been revoked. If you file a motion with the court where the probate has been filed, the court might grant you that right, but it is far from automatic.
