HOw much should it cost to process a probate estate

My father passed away in Florida last month without a will. We were estranged and his estate consists of a car and a home. How much would I expect to pay a lawyer to process an estate with those two assets only. He had no property as his home was broken in to in the last few weeks and everything of any value was stolen and the house was vandalized. My question really is how much and how long will it take to find closure in this matter.

It depends on the value of the estate. If less than $75,000 you could petition for Summary Administration which is fairly quick (approx. 7-8 weeks) and less expensive than formal administration (Summ. Admin. costs approx. $1200 to $1500 but attorneys charge different rates). I strongly recommend you speak with an attorney directly in order to best assess the value of the estate and potential issues involved.

Depends upon value of real property and and amount of work involved in probate (# of family members involved and filing of all signed papers)

$2,500 plus court costs would be a minimum.

If there are no creditors and all the heirs are able and willing to sign off, it should cost no more than $1,500 including court costs. If that is not the case, the cost would be in the $2,500 range.
