Legal Question in Wills and Trusts in Florida

creditors and no estate

My mothe died and left no estate. She had about $700 in her bank account when she died and many debts. I was able to get the money released to me by going to the court house and get an Order of Diposition w/o Administration. I used the money to help pay for her funeral.

She left a lot of credit card debt. Some of the companies have taken a copy of the death certificate and the court paper and I have not heard anything else. There are others who are offering me a payment plan and calling themselves ''probate specialists'' who have been hired by a credit card company to collect the debt. My understanding is that I do not inherit her debt. How do I get these companies to stop sending requests for payment?

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. If you do not agree, then stop right here, and do not read any further.

There is no sure way to get the creditors to stop sending requests for payment. I would simply return future statements unopened back to the send marked "Deceased". They will eventually get the message.
