Legal Question in Wills and Trusts in Florida
Can a curator sell items withot permission fo the court?
A curator was appointed for an estate. That person has not paid the taxes due on the real estate. In fact a tax certificate was sold, by the county, on the property a month ago. He has not paid any bills. The house is in disrepair and looks awful. It was a very nice home when the deceased lived in it. He has now informed the heirs that is going to sell all of the items in the house at public auction. None of us want that. A personal represenative is to be appointed soon, but the order has not been signed yet.
Can the curator sell the personal items in the estate without court permission or permission of the heirs?

Re: Can a curator sell items withot permission fo the court?
A curator cannot sell assets without permissin from the court. However, neither is he or she authorized to pay debts, including homeowner's taxes.
Make sure that an order from the court was not issued to sell the items you mentioned. If it wasn't, you should contact a local attorney immediately to check on the situation.
