;death- bank account

mother died leaving acct. to older sister (lives out of state). other family members had no knowledge of .mother told other fam. member to take money out for cremation.(also left blank check to same person) to take money from acct.(total amount in account 1000.00) crem. cost 435. account ben. trying to sue for $400.00, from unemployed person, what can be done?

You need to redo your question, using complete sentences and more clearly stating who did what. By the way, suing a person who has no assets, especially for $400, is a waste of time and leaves the person out the filing fee and other costs.
