How do you cash a chech sent to the ''estate of'' a deceased family member, who did not have a will.

The next of kin would have to go through some type of probate process. What type depends on several things, such as the amount, whether there are outstanding creditors, whether the heirs are in agreement, etc. When there is no will, the state law says who will inherit the decedent's estate, typically spouse and/or children.
