Death of credit card holder

My father died 8/11/06. He had a credit card with Citicorp with a balance olf $4000.00. My mother was not a card holder or co-signer on the account. Citicorp is now threatening to place her home in probate if she does not begin making payments on the account. It is my understanding that once the cardholder dies the spouse is not responsible. Please advise.

I agree with the last attorney's answer if this is a true credit card. Still, I might discuss this with an attorney just to be sure this is not some home equity line of credit extended by citicorp.

Tell them to kiss off. Even if the home were in his name alone, it is not subject to his creditors. They will tell you whatever they think will get them their money. She has no obligation to talk to them at all. She should tell them that her attorney told her not to talk to them and hang up IMMEDIATELY.
